Welcome to Energyrforce. By accessing or using our website at energyrforce.world and enrolling in our Spanish language courses, you agree to comply with and be bound by these Terms of Use. Please read them carefully.

Acceptance of Terms

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you may not access our services or use our website.

Course Enrollment and Access

To enroll in our Spanish language courses, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your account information

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Course Fees and Payment

All course fees are listed in Australian Dollars (AUD) and are subject to change. Payment is required at the time of enrollment unless alternative arrangements have been made. We accept various payment methods as indicated during the enrollment process. All fees are non-refundable except as specified in our Return Policy.

Class Attendance and Participation

Students are expected to attend scheduled classes punctually and participate actively. If you need to miss a class, please provide at least 24 hours notice to arrange a makeup session, subject to availability. Repeated absences without notice may result in course termination without refund.

Student Code of Conduct

All students must:

  • Treat instructors and fellow students with respect
  • Refrain from disruptive behavior during classes
  • Not record classes without explicit permission
  • Complete assignments and coursework honestly
  • Respect intellectual property rights of course materials

Violation of these conduct standards may result in removal from courses without refund.

Intellectual Property Rights

All course materials, including but not limited to videos, documents, exercises, and digital content provided by energyrforce, are protected by copyright and other intellectual property laws. You may use these materials solely for personal educational purposes. You may not:

  • Reproduce, distribute, or share course materials with others
  • Create derivative works based on our content
  • Use materials for commercial purposes
  • Remove copyright or proprietary notices

Acceptable Use

When using our website and services, you agree to use them only for lawful purposes and in accordance with these Terms of Use. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe upon intellectual property rights, privacy rights, or other rights of others
  • Transmit, upload, or distribute malicious code, viruses, malware, or harmful software
  • Attempt to gain unauthorized access to our systems, accounts, or networks

Limitation of Liability

Our Spanish language courses are provided on an "as is" and "as available" basis. While we strive to provide high-quality education, we make no warranties or guarantees regarding specific learning outcomes or language proficiency levels. Your success in learning Spanish depends on various factors including your dedication, practice time, and individual learning abilities.

Australian Consumer Law

Nothing in these Terms of Use excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). If you are a consumer under the ACL, you are entitled to certain guarantees that cannot be excluded, including:

  • Services will be provided with due care and skill
  • Services will be fit for the purpose for which they are supplied
  • Services will be supplied within a reasonable time

If we fail to meet any of these guarantees, you may be entitled to remedies including a refund, replacement, or compensation for damages. Our liability for failure to comply with a consumer guarantee is limited to, at our option:

  • The resupply of the services, or
  • The payment of the cost of having the services resupplied

Exclusions and Limitations

To the fullest extent permitted by law, and subject to your rights under the Australian Consumer Law, energyrforce shall not be liable for:

  • Any indirect, incidental, consequential, special, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage arising from your use of our services
  • Any damages resulting from unauthorized access to or use of your account
  • Any damages resulting from technical failures, interruptions, or errors

Our total liability to you for any claims arising from or related to these Terms of Use or our services shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless energyrforce, its instructors, and affiliates from any claims, damages, losses, or expenses arising from your violation of these Terms of Use or misuse of our services.

Dispute Resolution

If you have a complaint or dispute regarding our services or these Terms of Use, we encourage you to contact us first at clients-@energyrforce.world to attempt to resolve the matter directly.

If we cannot resolve the dispute through direct communication, you may:

  • Contact the Office of Fair Trading in your state or territory for assistance
  • Seek assistance from the Australian Competition and Consumer Commission (ACCC) if the dispute relates to consumer rights
  • Engage in alternative dispute resolution processes, such as mediation
  • Pursue legal action in accordance with the applicable law provisions below

We are committed to resolving disputes fairly and efficiently and will make good faith efforts to address your concerns.

Applicable Law

These Terms of Use are governed by the laws of South Australia, Australia, and the Commonwealth of Australia, including:

  • The Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law
  • The Privacy Act 1988 (Cth) and the Australian Privacy Principles
  • Other applicable federal and state laws of Australia

Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of South Australia, Australia. However, nothing in this provision prevents you from seeking remedies available under the Australian Consumer Law or other consumer protection legislation.

Changes to Terms

We may update these Terms of Use from time to time. The updated version will be posted on our website with a revised "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified terms.
